The most serious of these offenses are Capital Felonies that can bring a penalty of life imprisonment or death. The standard penalties for capital, first degree, second degree, third degree, and state jail felonies are set out in Sections 12.31, 12.32, 12.33, 12.34, and 12.35 of the Texas Penal Code.
